DMCA Policy

Overview

RealCostIQ respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.

Designated Copyright Agent

To submit a copyright infringement notice or counter-notice, contact our designated agent:

Filing a Takedown Notice

If you believe content on realcostiq.com infringes your copyright, send a written notice to our agent containing all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is sufficient.
  3. Identification of the material you claim is infringing, with enough detail for us to locate it on the site (e.g., a URL).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

Incomplete notices will not be acted upon. Submitting a false DMCA notice may expose you to legal liability under 17 U.S.C. ยง 512(f).

Counter-Notice Procedure

If material you posted was removed in response to a DMCA notice and you believe the removal was in error or the result of misidentification, you may submit a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal court in your district, and that you will accept service of process from the party who submitted the original notice.

Upon receipt of a valid counter-notice, we will forward it to the original claimant. If the claimant does not file a court action within 10โ€“14 business days, the removed material may be restored.

Repeat Infringer Policy

RealCostIQ reserves the right to terminate access for users who are found to be repeat infringers of third-party copyrights.
